In general, each State or jurisdiction must submit an application, including certifications, policies and procedures, and statement of assurances assurances to receive IDEA Part C FY 2009 funds; however no separate application were required for States to receive IDEA Part C ARRA funds. Each State lead agency is designated by the Governor of that State or jurisdiction. OMB Circular No. A-87 applies to this program.
What is the process for applying and being award this assistance?
Pre-Application Procedure
There was no separate application required for States to be eligible to receive IDEA Part C ARRA funds under the Recovery Act. Environmental impact information is not required for this program. This program is eligible for coverage under E.O. 12372, "Intergovernmental Review of Federal Programs." An applicant should consult the office or official designated as the single point of contact in his or her State for more information on the process the State requires to be followed in applying for assistance, if the State has selected the program for review.
Application Procedure
OMB Circular No. A-102 applies to this program. This program is excluded from coverage under OMB Circular No. A-110. A State did not need to submit a new application to receive the first 50 percent of its IDEA Part C ARRA because this portion of funds were made available to each State based on the Stateâ₏™s eligibility determination for FY 2008 Part C funds. States did not submit separate applications to receive the second 50 percent of its IDEA Part C ARRA funds but were required to comply with the record keeping and reporting requirements under section 1512 of the ARRA.
Award Procedure
Two grant awards, each representing 50 percent of the total State allocation of IDEA Part C ARRA funds under the Recovery Act were made to each State lead agency on April 1, 2009 and September 30, 2009 with the funds available for obligation on February 17, 2009.

How are proposals selected?
State lead agencies designated by the Governor are eligible applicants and must submit an approved application under Part C of the IDEA for regular FY 2009 IDEA Part C funds; as noted above, applications were not required for IDEA Part C ARRA funds.
How may assistance be used?
IDEA Part C AARA funds are used to assist States in implementing and maintaining their statewide systems of early intervention services. Funding may also be used to provide direct services for eligible infants and toddlers with disabilities aged birth through 2 and their families that are not otherwise provided by other public or private sources, to expand and improve services for infants and toddlers with disabilities that are otherwise available, and to provide a free appropriate public education, in accordance with Part B of IDEA, to children with disabilities from their third birthday to the beginning of the following school year. States also have the discretion to provide services to infants and toddlers who are at risk of having substantial developmental delays if they do not receive appropriate early intervention services. The Individuals with Disabilities Education Improvement Act of 2004 amended IDEA to allow states, at their discretion, to continue to serve children with disabilities under this program beyond age three until the children enter or are eligible to enter kindergarten or elementary school, if such children are otherwise eligible for services under the Preschool Grants Program (84.173), and previously received services under the Part C program.
What are the requirements after being awarded this opportunity?
Reporting
State lead agencies must submit an Annual Performance Report under IDEA sections 616 and 642. An annual report to the Governor and to the Secretary by the State Interagency Coordinating Council on the status of early intervention programs operated within the State as required under Section 641(e)(1)(D) of the Act, and other information that the Secretary may require, including information required under Section 618 of the Act. Annual State Performance Plans and Annual Performance Reports are submitted to the Department of Education by the lead agency on an annual basis. For the ARRA program funds, States must also report quarterly and separately beginning on October 1, 2009 under ARRA section 1512 on how IDEA Part C ARRA funds under this program are spent. Cash reports are not applicable. Progress reports are not applicable. Reporting requirements will be included in the grant award document. Performance monitoring requirements will be included in the grant award document.
Auditing
In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.
Records
As required by GEPA and EDGAR for State-administered programs (in 34 CFR 76.730-731). Generally, the State lead agency and its contractors must retain records related to grant funds and compliance for a period of 5 years.

Formula and Matching Requirements
Statutory Formula: Part C.
Matching Requirements: Funds available under the Recovery Act are distributed based on the regular Part C statutory formula. Awards are based on each State applicant's proportionate share of children, aged birth through two years, in the general population, based on the most recent satisfactory data available from the United States Bureau of the Census. No State receives less than 0.5 percent of the total amount of funds available for all States. The four Outlying Areas combined receive up to 1 percent of the funds appropriated for the IDEA Part C program.

Length and Time Phasing of Assistance
IDEA Part C ARRA FY 2009 funds are available for obligation at the Federal level until September 30, 2010. State agencies have an additional 12-month period to obligate their funds (i.e., until September 30, 2011).
