The States must submit an application describing the status of the Stateâ₏™s progress in improving the equitable distribution of qualified teachers; establishing longitudinal data systems; enhancing the quality of assessments; including English language learners and students with disabilities in State assessments; improving academic content and achievement standards; and providing effective support to schools identified for corrective action and restructuring. In addition, the application must include a description of the strategies the State is employing to help ensure that students in subgroups that have not met the Stateâ₏™s proficiency targets continue to make progress toward meeting the Stateâ₏™s student academic achievement standards; the achievement and graduation rates of public elementary and secondary students and strategies the State is employing to help ensure that all subgroups of students continue making progress toward meeting the Stateâ₏™s student academic achievement standards; how the State would use its grant funding to improve student academic achievement in the State, including how it will allocate the funds to give priority to high-need local educational agencies; and a plan for evaluating the Stateâ₏™s progress in closing achievement gaps.
Award Procedure
The Department of Education determines which States receives Race to the Top grants and the amount of those grants, on the basis of the States applications under section 14005 and other criteria the Department determines appropriate. The Department will make Race to the Top awards in FY 2010.

How may assistance be used?
Race to theTop State grants reward States that have made significant progress in improving the equitable distribution of qualified teachers; establishing longitudinal data systems; enhancing the quality of assessments; including English language learners and students with disabilities in State assessments; improving academic content and achievement standards; and providing effective support to schools identified for corrective action and restructuring. Each State receiving a Race to the Top grant shall use at least 50 percent of its grant to provide subgrants to school districts based on their relative shares of funding under Title I for the most recent year. The Race to the Top Assessment Program provides funding to consortia of States to develop assessments that are valid, support and inform instruction, provide accurate information about what students know and can do, and measure student achievement against standards designed to ensure that all students gain the knowledge and skills needed to succeed in college and the workplace. These assessments are intended to play a critical role in educational systems; provide administrators, educators, parents, and students with the data and information needed to continuously improve teaching and learning; and help meet the President's goal of restoring, by 2020, the nation's position as the world leader in college graduates.

Auditing
In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133. All grantees are subject to the provisions of the Single Audit Act, 31 U.S.C. 75, and OMB circular A-133.
Records
Each recipient must maintain records that fully disclose the total cost of the activity for which the funds are used, the share of the cost provided from other sources, and other such records as will facilitate an effective financial or programmatic audit. The recipient shall maintain such records for 3 years after the completion of the activity for which funds are used.
