In fiscal year 2011, eligibility was limited to States that were finalists but did not receive funding under the 2010 Race to the Top Fund Phase 2 competition.

Application Procedure
This program is excluded from coverage under OMB Circular No. A-102. This program is excluded from coverage under OMB Circular No. A-110. The Secretary proposes the following requirements for awards under Phase 3 of the Race to the Top Fund. The Department will make awards through a two-part process. Under Part I, eligible applicants must submit an application that meets the requirements of section II and the assurances required under section III(a) through (f) in this notice. Section II includes a new requirement for active participation in a Race to the Top assessment consortium, reflecting the importance of high quality assessment systems to the successful implementation of the comprehensive statewide reforms envisioned under the Race to the Top program. Under Part II of the application process, applicants that meet the requirements of Part I and receive notification of the amount of funds they will receive must submit a detailed plan and budget describing the activities selected from the State’s Race to the Top Phase 2 application that will be implemented with Phase 3 funding, including an explanation of why the applicant has selected these activities and why the applicant believes such activities will have the greatest impact on advancing their overall statewide reform plans. The plan also must include a description of the process for allocating at least 50 percent of Phase 3 funds to participating LEAs and the activities to be implemented with LEA-level funds.
Award Procedure
The Secretary of Education will determine which States receive Race to the Top grants, on the basis of the States applications under section 14005 and other criteria the Secretary determines appropriate, which may include a State’s need for assistance. The Secretary will make Race to the Top awards in FY 2012.

Race to the Top grants will reward States that have made significant progress in improving the equitable distribution of qualified teachers; establishing longitudinal data systems; enhancing the quality of assessments; improving academic content and achievement standards; and providing effective support to schools identified for corrective action and restructuring. States receiving an incentive grant shall use at least 50 percent of its grants to provide school districts with subgrants based on their most recent relative Title I allocations.

Auditing
In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.
Records

Generally, the State and its subgrantees must retain records related to grant funds and compliance for a period of 3 years from the date the grantee or subgrantee submits its final expenditure report for that funding period. 34 CFR 80.42. Also, all records supporting claims for Federal funds or relating to the accountability of the grantee for the expenditure of such funds must be accessible for administrative review.
