To assist and encourage incarcerated individuals who have obtained a secondary school diploma or its recognized equivalent to acquire educational and job skills through coursework in order to prepare such individuals to pursue a postsecondary education certificate, an associate’s degree, or bachelor’s degree while in prison; and to provide them with employment counseling and other related services.

Who is eligible to apply/benefit from this assistance?
Applicant Eligibility
State correctional education agencies, as designated by the Governor of any of the 50 States, the Commonwealth of Puerto Rico, District of Columbia, Guam, American Samoa, the Virgin Islands, and the Northern Mariana Islands, may apply.
Beneficiary Eligibility
Individuals who: (1) are incarcerated in a State prison; (2) are eligible to be released or paroled within 7 years; (3) are 35 years of age or younger; (4) were not convicted of certain crimes; and (5) have obtained a secondary school diploma or its equivalent.
Credentials/Documentation
A State plan is required. The State plan must include a certification from a State official that all provisions and amendments thereto are consistent with the Act. This program is excluded from coverage under OMB Circular No. A-87.
What is the process for applying and being award this assistance?
Pre-Application Procedure
The Department of Education will provide guidance on specific issues and technical assistance in the preparation of State Plans. Environmental impact information is not required for this program. This program is excluded from coverage under E.O. 12372.
Application Procedure
OMB Circular No. A-102 applies to this program. OMB Circular No. A-110 applies to this program. Each designated State correctional education agency must submit to the Secretary of Education a State plan, which sets forth the procedures under which the State will carry out activities to achieve its program objectives and priorities and fulfill the purposes of the Act.
Award Procedure
The Secretary approves the State Plan and any amendment thereto and makes allocations to the State.

How may assistance be used?
State correctional education agencies that receive a grant use funds to assist and encourage incarcerated individuals who have obtained a secondary school diploma or its recognized equivalent to acquire educational and job skills through coursework to prepare such individuals to pursue a postsecondary education certificate, an associate’s degree, or bachelor’s degree while in prison; and to provide them with employment counseling and other related services. Educational and related services must start during the period of incarceration in prison or prerelease; the related services may continue for not more than two years after release from confinement.
What are the requirements after being awarded this opportunity?
Reporting
Annual Financial and Program Performance Reports in accordance with the statutory requirements of the program and the provisions in EDGAR. No cash reports are required. No progress reports are required. No expenditure reports are required. No performance monitoring is required.
Auditing
In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.

In accordance with Section 443 of the General Education Provisions Act, grantees must maintain records for 3 years.

Formula and Matching Requirements
Statutory Formula: 20 USC 1151. From the amount appropriated, the Secretary allots to each State an amount that bears the same relationship to the amount appropriated as the total number of eligible individuals in each State bears to the total number of eligible individuals in all States.

Length and Time Phasing of Assistance
